This Terms of Service Agreement (“Agreement”) outlines the terms and conditions applicable to all web hosting, cloud hosting, and reseller hosting services provided by HostDactyl. By registering for or using our services, you agree to be bound by this Agreement.
1. ACCOUNT ELIGIBILITY
1.1. Minimum Age Requirement
You must be at least 18 years of age to use our services. We reserve the right to suspend or terminate any account associated with a user under this age.
1.2. Third-Party Registrations
If you register an account on behalf of a third party, you represent and warrant that you have the authority to bind that third party to this Agreement and that they have agreed to be bound by these terms.
1.3. Account Security
You are solely responsible for maintaining the confidentiality of your account credentials. HostDactyl shall not be held liable for any loss or damage resulting from unauthorized account access due to weak or compromised passwords.
1.4. Accurate Information
You agree to provide accurate, current, and complete information during the registration process. Failure to do so may result in suspension or termination of services.
1.5. Verification
We reserve the right to request identity or payment verification, including photo identification or credit card confirmation, to prevent fraud. Failure to comply may result in service denial or cancellation.
1.6. Compliance with Laws
You agree to use our services only in compliance with all applicable local, national, and international laws. Illegal, abusive, or unethical use of our services is strictly prohibited.
2. PROHIBITED ACTIVITIES
The following activities are strictly prohibited. Accounts engaging in these may be suspended or terminated without notice:
Running IRC servers or related services
Use of automated browsing tools, bots, or traffic exchanges
Hosting pirated software, warez, or illegal downloads/uploads
Hacking tools, brute-force programs, port scanners, or IP scanners
Sending unsolicited bulk emails (spam)
Engaging in fraudulent activities (HYIP, Ponzi schemes, etc.)
Operating gambling, lottery, or betting websites
Running public VPNs, proxies, anonymizers, or TOR exit nodes
Cryptocurrency mining or similar high-resource activities
Hosting phishing pages, malware, or fake login portals
Illegal file hosting or unauthorized streaming services
Hosting adult content or sexually explicit material
Any action that overloads our servers or disrupts network stability
Attempting to bypass security or gain unauthorized access
Note: HostDactyl reserves the right to determine what constitutes abuse or violation and to update this list as needed.
3. USAGE POLICY
3.1. Fair Use & Unlimited Resources
“Unlimited” bandwidth and storage apply to standard business and personal websites only. Excessive use (e.g., exceeding 15GB/day bandwidth or using hosting as a file storage system) may result in account suspension or the need to upgrade to a VPS or dedicated server.
3.2. Resource Limits
Activities affecting server performance or network stability may lead to throttling, restrictions, or termination. We may recommend migration to a more suitable hosting plan if resource usage is deemed excessive.
4. RESELLER TERMS & CLIENT RESPONSIBILITIES
4.1. Resellers must ensure their clients comply with all HostDactyl policies.
4.2. Reselling shared hosting accounts is strictly prohibited; resellers must use proper reseller plans.
4.3. Resellers are responsible for their own billing, technical support, and client communications.
4.4. HostDactyl does not offer end-user support for reseller clients.
4.5. HostDactyl reserves the right to audit, review, or modify reseller services to ensure compliance.
We reserve the right to intervene in cases of illegal activity or abuse by reseller clients.
5. SECURE SHELL (SSH) ACCESS
SSH access is disabled by default but may be enabled upon request with valid justification. Abuse of SSH privileges, including attempts to compromise server security, will result in immediate termination.
6. OUTGOING EMAIL & SPAM POLICY
6.1. All outbound mail must comply with anti-spam regulations, including CAN-SPAM and GDPR.
6.2. Accounts sending spam, mass marketing emails, or unsolicited messages may have their email functionality restricted.
6.3. Repeat offenses may result in account suspension or termination.
7. NETWORK & SERVER CLEANLINESS
We are committed to maintaining a secure, spam-free network. HostDactyl actively monitors and mitigates abuse to maintain IP reputation, server health, and fair resource availability for all customers.
8. PAYMENT & BILLING
8.1. All payments are due in advance of service activation.
8.2. Failure to pay on time may result in service suspension or cancellation.
8.3. HostDactyl reserves the right to revise pricing, plan structures, and promotions with prior notice.
9. TERMINATION
9.1. By HostDactyl
We reserve the right to suspend or terminate any account at our discretion for violations of this Agreement, security threats, or abuse.
9.2. By Customer
Customers may cancel their services at any time through the client area. Cancellation requests must be made at least 7 days before the next billing cycle.
10. BACKUPS
Unless otherwise stated, customers are responsible for maintaining their own website and data backups. HostDactyl may offer automated backups as part of some hosting plans but does not guarantee availability or completeness of any backup.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law, HostDactyl shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services, including loss of data or revenue. Our total liability under this Agreement shall not exceed the amount paid by the customer for the service during the six (6) months prior to the event giving rise to the claim.
12. MODIFICATIONS TO TERMS
HostDactyl may update or modify these Terms of Service at any time. Changes will be posted on our website, and continued use of the services constitutes acceptance of the updated terms.
